Board of Trustees approve NIL policy

The Board Policy 3730; Athletics; Name, Image and Likeness (NIL) Activities was approved by the Nebraska State College System (NSCS) Board of Trustees during its visit to campus, Friday Sept. 9.

With this approval, student-athletes at Chadron State College, Wayne State College, and Peru State College are now able to earn compensation for the use of their name, image, likeness or athletic reputation as long as the limitations of the policy are followed

For college student-athletes to participate in contracts with sponsors, the listed limitations must be followed:

– The compensation that student-athletes earn must be agreed upon between the student-athlete and the sponsor and it must be for actual work or services performed.

– Student-athletes shall not enter contracts that require said athlete to enroll in a particular college, athletic participation or performance.

– Student-athletes shall not enter contracts with vendors associated with gambling or sports wagering, performance enhancing drugs, or with alcohol or illegal drugs.

– Boosters shall not provide professional representation to a student-athlete unless the compensation is arranged on behalf of a business entity, like if the Booster is an owner, an employee, or has direct relations with the entity.

– Student-Athletes shall not enter contracts for compensation that requires student athletes to display sponsor’s apparel or advertise for sponsor during official team and following the contract would interfere with a team contract.

– College and NSCS employees are prohibited from compensating, arranging compensation or negotiating on behalf of a student-athlete for NIL activities.

– Any athlete who enters into a contract for NIL activities must disclose information with the Athletic Director of the College in writing within five business days of signing the contract by providing a copy of the applicable contract. Unless required by law, the college must not disclose any terms of a student athlete’s NIL activity contract that the student-athlete or professional representation deems to be a trade secret or nondisclosable.

– Student-Athletes occupied with NIL activity shall not use or display the College’s name, brand logo, trademark without written approval from the college. The use includes wearing college apparel, wearing athletic uniforms, displaying mascots, banners or posters.
